Risk Disclosure – WatsUp Waiheke
By completing this booking, you have acknowledged and agree that:
1. Inherent Risks
Water sports and related beach activities carry inherent risks, including slips, falls, drowning, weather changes, equipment failure, and collisions. Participation is entirely
at your own risk.
2. Responsibility & Safety
You agree to use all hired equipment safely, follow all safety instructions, and ensure that every participant under your booking does the same. You confirm that all
participants are competent swimmers and physically able to take part. Children must be supervised by a responsible adult at all times.
3. Hirer Responsibility
You accept full responsibility for the actions, safety, and conduct of all participants included in your booking, and for any loss or damage to equipment during the hire
period.
4. Liability
To the fullest extent permitted by New Zealand law, WATSUP Waiheke and its staff are not liable for any injury, loss, or damage arising from use of hired equipment or participation in related activities.
5. Consumer Rights
Nothing in this disclosure limits your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986, where those rights cannot lawfully be excluded.
6. Acknowledgement
By proceeding, you confirm that you have read, understood, and accept this risk disclosure on behalf of yourself and all participants in your booking.
